These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by DeSoto County.
REQUEST FOR RELEASE OF FUNDS
On or about ___September 12, 2026____, DeSoto County will submit a request to the Florida Department of Commerce for release of Community Development Block Grant-Disaster Recovery (CDBG-DR) funds under applicable CDBG-DR appropriations and Title I of the Housing and Community Development Act of 1974, as amended, for the DeSoto County Wastewater Treatment Plant (WWTP) Effluent Project, MS010. The project will construct one deep injection well and one monitoring well at 7728 SE State Road 31, Arcadia, Florida 34266, with related drilling, testing, casing, wellheads, valves, ports and monitoring appurtenances for treated wastewater effluent disposal. Funding includes $8,000,000 in HUD CDBG-DR funds and $5,000,000 in non-HUD State Legislative Appropriations/FDEP funding, for an estimated total project cost of $13,000,000.
FINDING OF NO SIGNIFICANT IMPACT
DeSoto County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the DeSoto County Administration Building, 201 East Oak Street, Suite 201, Arcadia, Florida 34266, where it may be examined during normal County business hours. The ERR will also be available on the DeSoto County website.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Dennis Johnson, Grants Coordinator, DeSoto County, 201 East Oak Street, Suite 201, Arcadia, Florida 34266, or d.johnson@desotobocc.com. All comments received by September 10, 2026 , will be considered by DeSoto County prior to submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
DeSoto County certifies to the Florida Department of Commerce that Mandy Hines, in her capacity as County Administrator and Certifying Officer, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities relating to the environmental review process and that these responsibilities have been satisfied. The State's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows DeSoto County to use CDBG-DR program funds.
OBJECTIONS TO RELEASE OF FUNDS
The Florida Department of Commerce will accept objections to its release of funds and DeSoto County's certification for fifteen days following the anticipated submission date or actual receipt of the request, whichever is later, only on the bases allowed by 24 CFR Part 58. These include failure of the Certifying Officer to execute the certification; omission of a required environmental review step, decision, or finding; commitment of funds or undertaking of activities not authorized by 24 CFR Part 58 before approval of the release of funds; or a written finding by another Federal agency under 40 CFR Part 1504 that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with 24 CFR 58.76 and addressed to the Florida Department of Commerce at the address or submission location specified by the Department. Potential objectors should contact the Florida Department of Commerce to verify the actual last day of the objection period.
